Terms of service

These terms apply when you browse kasentials.com or purchase from K.A. Essentials. By using the website or placing an order, you agree to these terms together with our Privacy Policy, Shipping Policy and Return and Refund Policy. Nothing in these terms limits your statutory rights under UK consumer law.

Products and availability

We aim to describe and display products accurately. Colours, packaging and minor product details may vary because of screen settings or supplier updates. All products are subject to availability. We may correct errors, update information, limit quantities or withdraw a product before accepting an order.

Prices and payment

Prices are shown in pounds sterling. Delivery charges are shown at checkout before payment. Payment must be authorised before an order is accepted. If a pricing or availability error affects an order, we will contact you and offer the choice of proceeding with the corrected information or receiving a refund.

Orders

Submitting an order is an offer to buy. A contract is formed when we send an order confirmation or otherwise confirm acceptance. We may refuse or cancel an order where payment is not authorised, stock is unavailable, information is inaccurate, fraud is suspected or fulfilment is not reasonably possible. If payment has already been taken for a cancelled order, it will be refunded.

Delivery

Delivery services, charges and estimates are explained in our Shipping Policy. Products may be dispatched by approved fulfilment partners and items in one order may arrive separately. Delivery estimates are not guarantees, although we will act reasonably to resolve delays and fulfil our obligations under applicable law.

Cancellations, returns and refunds

Cancellation, return and refund rights are explained in our Return and Refund Policy. Contact kudus@kasentials.com before returning an item. These policies do not reduce any rights you have under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013 or other applicable law.

Accounts and information

You are responsible for providing accurate contact, billing and delivery information and for keeping account credentials secure. You must not use the website unlawfully, attempt unauthorised access, interfere with its operation, introduce malicious code or misuse another person’s information.

Intellectual property

The K.A. Essentials name, website design, original text, graphics and branding are owned by us or used with permission. Product names, images and trademarks belonging to suppliers or other owners remain their property. Content may not be copied, republished or commercially exploited without permission, except where allowed by law.

Third-party services

The store is hosted by Shopify and may use third-party payment, delivery and fulfilment services. Those providers may process information needed to provide their services, as explained in our Privacy Policy. Links to third-party websites are provided for convenience; we are not responsible for their independent content or practices.

Liability

We do not exclude liability where it cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or breach of statutory consumer rights. Subject to that, we are not responsible for losses that were not reasonably foreseeable when the contract was formed, or for business losses arising from a consumer purchase.

Personal information is handled in accordance with our Privacy Policy and applicable UK data-protection law.

Changes

We may update these terms when our services or legal obligations change. The terms that apply to an order are those in force when the order is placed.

Governing law

These terms are governed by the laws of England and Wales. Consumers living elsewhere in the United Kingdom retain any mandatory protections and may bring proceedings in the courts available to them under applicable law.
